Background information

This law is set against the backdrop of Luxembourg's labor shortage. It completes the amendments transposing Directive 2014/36/EU of the European Parliament and of the Council of February 26, 2014 on the conditions of entry and residence of third-country nationals for the purposes of employment as seasonal workers. It completes the legislative amendments transposing Directive (EU) 2021/1883 of the European Parliament and of the Council of October 20, 2021 and repealing Council Directive 2009/50/EC.

Content of measure

The amendments update the previous EU Blue Card rules as set out in Council Directive 2009/50/EC of May 25, 2009 for the purposes of highly-skilled jobs, and to provide the European Union with a targeted legal migration system capable of addressing skills shortages and making it easier for highly skilled professionals to join the workforce. These amendments are based on the adoption by the Chamber of Deputies and the decision of the Chamber of Deputies on July 11, 2024, and that of the Council of State on July 12, 2024. They define the authorization for the purposes of seasonal work issued to the third-country national and accompany the text with written information on rights and obligations under Directive 2014/36/EU of the European Parliament and of the Council of February 26, 2014 on the conditions of entry and residence of third-country nationals for the purposes of employment as seasonal workers, including appeal procedures.

Use of measure

The law concerns all companies and economic sectors in Luxembourg. There is no funding to accompany this legislative development.
