Background information

The law transposes into national law Directive (EU) 2021/1883 of the European Parliament and of the Council of 20 October 2021 on the conditions of entry and residence of third-country nationals for the purposes of highly qualified employment, and repealing Council Directive 2009/50/EC. The amendments update the previous EU Blue Card rules resulting from Council Directive 2009/50/EC of May 25, 2009 for the purpose of highly skilled employment, and to provide the European Union with a targeted legal migration system capable of addressing skills shortages and making it easier for highly skilled professionals to join the workforce

Content of measure

The law of April 21, 2023 (Mém. A228 of 08/05/2023) amends the amended law of August 29, 2008 on the free movement of persons and immigration. The main aim of this law is to structure the various categories of removal measures in a clear and coherent way, with a view to better managing the phenomenon of illegal residence of third-country nationals on Luxembourg territory. More specifically, the text provides for more flexible admission conditions for highly-skilled foreign workers, notably with regard to the minimum wage threshold, reinforced rights, more favorable conditions for family reunification, and the possibility of traveling and working more easily in other EU member states. At the same time, it tightens controls and sanctions on irregular workers and the companies that use them
