Starting with 1 September 2024 new legal dispositions regulate the application for a work permit for foreign workers. These legal measures, which directly impact the employer of a foreign worker, aim to prevent illegal employment and guarantee decent working and living conditions for foreign workers by imposing a stricter regime for the required documentation when recruiting a foreign worker. This measure is related to case "FR-2025-4/3788" named "Sanctions for illegal employment".
Based on the new regulation, the employer needs to provide the following documents in order to hire foreign workers for unlimited or short-time work contracts: * a certificate of payment of social security contributions dated 6 months or less; * the adequacy between hiring and the economic activity carried out; * a copy of the job offer submitted to an organization contributing to the public employment service (only if the position is subject to the enforceability of the employment situation).
In addition, in order to employ seasonal workers, the employer needs to provide: * a copy of the employment contract, signed by the employer and the employee and corresponding to the requested work permit; * the address of suitable housing for the employee, as well as a sworn statement from the employer guaranteeing its availability to the employee; * a copy of the employer ID.
